$2.2M lawsuit filed after pedestrian death involving police

A $2.2 million lawsuit alleging negligence has been filed against a York Region police officer and the police service that employs him after the death of an 18-year-old female pedestrian, says Toronto critical injury lawyer John McLeish, partner with McLeish Orlando LLP.

In February, Natasha Carla Abogado was crossing St. Clair Ave. E., west of Warden Avenue.  She was struck and killed by an unmarked police car driven by an on-duty police officer.

Ontario’s Special Investigations Unit is investigating the circumstances of the case. As well, the Crown has laid a criminal charge of dangerous driving causing death against York Regional Police Det. Const. Remo Romano.

The damages lawsuit, filed on behalf of  Abogado’s parents, brother and sister – all represented by McLeish – names both Romano and the York Regional Police as defendants.

‘Tragic event’

“This was a tragic event and Carla’s family is suffering,” says McLeish.

The statement of claim alleges Romano was negligent due to several factors, including travelling at too high a rate of speed and not keeping a proper look-out.

The police car was equipped with an event data recorder that has not yet been made available to the Abogado family.

“I’m looking forward to seeing the data on the black box, as it will give details on the police officer’s speed and whether or not he attempted to brake,” says McLeish.
